On 6 December 2024, the Australian Government introduced the National Innovation (subclass 858) visa, replacing the Global Talent (subclass 858) visa. This change is part of the Federal Government’s broader strategy outlined in the 2024/25 Budget to attract highly skilled individuals who can drive innovation and economic growth across key sectors.

What is the National Innovation Visa?

The National Innovation Visa (NIV) retains similar criteria to the former Global Talent visa, targeting individuals with an internationally recognised record of exceptional and outstanding achievement in fields such as:

  • Professions (e.g. researchers, academics, industry experts)
  • Sport (e.g. world-class athletes)
  • The Arts (e.g. renowned creatives and artists)
  • Academia and Research (e.g. thought leaders and pioneering scientists)

Applicants must be prominent in their field, demonstrate they would be an asset to the Australian community, and show they would have no difficulty securing employment or establishing themselves independently. Additionally, they must be nominated by an Australian citizen, permanent resident, or organisation with national standing in their area of expertise.

How to Apply for the NIV

The application process for the National Innovation Visa involves two key stages:

  1. Expression of Interest (EOI): Applicants must first submit an EOI via the Department of Home Affairs’ online portal. This is a free submission and not considered a formal visa application.
  2. Invitation to Apply: Only applicants invited by the Minister can submit a formal visa application.

Changes to the Visa Process

Under the new regulations, applicants must now receive a formal invitation from the Minister before applying for the NIV. The role of the Prime Minister’s Special Envoy for Global Business and Talent Attraction has been removed due to low utilisation. These changes streamline the process and focus on an applicant’s achievements and their potential to contribute to Australia’s economy.

Transitional Arrangements

The Global Talent visa (subclass 858) is now closed to new applications.

Applications submitted before 6 December 2024 will be assessed under the criteria in place at the time of application. The new NIV regulations apply only to applications lodged from 6 December 2024 onwards.

Benefits of the National Innovation Visa

The NIV offers several advantages, including:

  • Permanent Residency: Successful applicants are granted permanent residency, allowing them to live, work, and study in Australia indefinitely.
  • Flexibility: There are no age limits, and applicants with less than functional English can opt to pay a second Visa Application Charge.
