Condition 8607 – Must only work in nominated occupation
Condition 8607 is a mandatory condition applied to all primary Temporary Skill Shortage (TSS) Subclass 482 visa, limiting visa holders to remain employed in their nominated occupation, with their approved sponsors.
TSS Visa holders who would like to change employers, however, remain in the same occupation must apply for a new nomination. TSS Visa holders who would like to change both employers and occupations must apply for both a new nomination and visa. This applies to those who would like to change occupations under the same employer, a new nomination and visa is required. Nominations must be approved, and visas must be granted prior to the TSS Visa holder commencing their new job.
The condition additionally requires TSS Visa holders to:
- Start work within 90 days of arriving in Australia (outside of Australia when the Visa was granted) or 90 days from when the visa was granted (in Australia when the Visa was granted).
- Not stop working for more than 60 consecutive days.
- If it is mandatory to have a licence, registration, or membership to do the nominated job, the visa holder must hold that licence, registration or membership.
Condition 8607 for TSS Visa holders in exempt occupations
Condition 8607 operates differently for occupations exempt under Migration (LIN 19/212:Specification of Occupations—Subclass 482 Visa) Instrument 2019. Exempt occupations are listed in the table below.
TSS Visa holders who have approved nominations for occupations listed as an exempt occupation are able to work for multiple employers at the same time, in the same occupation. TSS Visa holders working in exempt occupations are not required to have approve nominations if they would like to change employers. However, the Visa holder must continue to work in the same occupation for the TSS Visa to remain valid.
