Whether you are a start-up, established business or an international company, finding the perfect candidate for a role in your company can be hard work. We hear that some employers (regardless of the size of the organisation) often go through the whole recruiting process, find the ideal candidate and then discover they need to sponsor them for a visa to live and work in Australia as soon as possible.
A quick solution may be to use the Temporary Skill Shortage (Subclass 482) visa which allows employers to address labour shortages by bringing in skilled workers to work in an Australian business. This visa allows Australian employers to sponsor a visa holder for up to four years depending on the position. A shorter period is also permissible for employers that request a more dynamic arrangement.
The Temporary Skill Shortage (Subclass 482) visa process has three main steps:
- A Business Sponsorship agreement with the Department of Home Affairs (DHA) which authorises the employer to sponsor skilled overseas workers. The agreement may be either Accredited or Standard Business Sponsorship;
- 482 TSS Nomination which sets out the skilled position to be filled by the visa holder; and
- 482 TSS Visa which relates to the prospective employee who will fill the skilled position.
The third step may be expedited in situations where a prospective employee already holds a sponsored visa (such as a 457 or 482 TSS visa) and we may be able to assist in transferring the nomination of that employee. In doing so, we are able to reduce paperwork to save time and money.
The Temporary Skill Shortage (Subclass 482) visa is only one solution and there may be other visa options to allow your employee to live and work in Australia. Please complete our employer questionnaire and one of our lawyers will assess and advise on the options available to your business to sponsor an employee to work in Australia.
