Further Permanent Residency options may be open to you as a result from working from home during the pandemic

Under new changes which are due to come into force 1 July 2022, select Temporary Skill Shortage (subclass 482) and Temporary Work (subclass 457) visa holders, who stayed in Australia during the pandemic may be able to apply for permanent residency under the Employer Nomination Scheme (subclass 186) visa program.

This will give workers more certainty about their stay in Australia and employers a greater ability to retain staff to continue business as normal.

Temporary Skill Shortage visa holders (who are currently on the Short-Term stream) will be eligible to apply if they:

  • are the primary visa holder of a subclass 482 visa (Short term stream) in the nominated occupation under their nominating employer;
  • have been in Australia for a period of at least 12 months between 1 February 2020 and 14 December 2021
  • currently work for their nominating employer (and in their nominated occupation)
  • have worked or will have worked in their nominated occupation for three years full time for their nominating employer in the four years preceding lodgement

The change also assists specified 457 visa holders. This includes those who, on 18 April 2017, held or applied for a subclass 457 visa that was subsequently granted.

All applicants will be required to meet the 186 visa requirements in regards to English level, character/health requirements and age requirements unless they are exempt.
